Terms and Conditions

Important terms: Quotes last seven days. The prepaid label includes compensation up to £100. Payment is normally sent within 24 hours after inspection and acceptance. Returns following a rejected revised offer are free, except that a £25 administration and return charge may apply to a blacklisted device or counterfeit parts/device.

1. About PhoneSwapper

PhoneSwapper is a trading name of Sam Ellis, a sole trader. In these terms, “PhoneSwapper”, “we”, “us” and “our” mean Sam Ellis trading as PhoneSwapper.

These terms apply when an individual acting mainly outside their trade or profession asks us to value and purchase a mobile device through our website. You must read them before submitting an order.

2. Who may use this service

You must be at least 18 years old, live in the United Kingdom and be legally able to enter into a contract. By submitting an order, you confirm that the information you provide is complete and accurate.

3. Ownership of the device

You may send us a device only if:
- you own it and have the right to sell it;
- it is not stolen, lost, counterfeit or subject to another person’s rights;
- it is not subject to unpaid finance, hire purchase, a lease or another agreement that prevents its sale; and
- its IMEI or serial number has not been blocked or blacklisted, unless you clearly tell us before sending it.

We may ask for proof of identity, proof of address, proof of purchase or evidence of ownership. We may suspend an order, withhold payment and cooperate with the police, a network provider, an insurer or another relevant authority where we reasonably suspect fraud, theft, blacklisting or unlawful ownership.

4. Quotes

Our website quote is based on the device model, storage, condition and other information you select. It is an initial estimate, not a guaranteed purchase price.
A quote is valid for seven calendar days from the date it is issued. The device must be handed to the carrier using the supplied label within that period. If it is posted later, we may inspect it and issue a new quote based on its condition and market value when received.
A clear pricing or system error does not bind us where it should reasonably have been obvious that the quote was incorrect. If this happens, we will explain the error and offer a corrected quote or return the device free of charge.

5. Preparing your device

Before posting your device, you must:
- back up anything you wish to keep;
- remove SIM cards and memory cards;
- sign out of and remove Apple, Google, Samsung and other accounts;disable activation locks and services such as Find My;
- erase your personal data and restore the device to factory settings where possible; and
- remove any case or accessory that you do not intend to include.

We are not responsible for SIM cards, memory cards, cases or other items sent accidentally. We may securely dispose of them. Although we may erase devices as part of processing, this is not a substitute for you backing up and deleting your information before posting.

6. Posting your device

We provide a Royal Mail prepaid returns service. You must use the label or QR code for the correct order, package the device securely and obtain proof of postage. Keep that proof until your order is completed.
The supplied service includes carrier compensation up to a maximum of £100, subject to the carrier’s rules and acceptance of a claim. If your device is worth more than £100 and you want greater cover, contact us before posting or arrange a suitable insured service at your own cost. Do not use an alternative service without first confirming the delivery address with us.
If a parcel is lost or damaged in transit, tell us promptly and provide the proof of postage, photographs, value evidence and any other information reasonably needed for a carrier claim. Any payment for transit loss is limited to the amount actually recovered from the carrier, up to £100, unless the loss or damage was caused by our failure to use reasonable care or the law requires otherwise.
We are not responsible for damage caused by inadequate packaging. You must not post a swollen, leaking, recalled or otherwise unsafe lithium battery. Contact us first if you believe a device may be unsafe to transport.

7. Device condition categories

The condition selected on the quote form forms part of your description of the device. The device must be the make, model and storage capacity selected and must meet the applicable condition rules below. Cosmetic wear is assessed under normal lighting without magnification. We inspect the whole device, including the screen, housing, camera surround and controls.

Good

A device selected as Good must:
- have no visible scratches, cracks, chips, dents, scuffs, missing paint, engravings, pressure marks, screen burn, discolouration or dead pixels;
- power on, charge and operate fully, with the display, touchscreen, cameras, speakers, microphones, buttons, vibration, Wi-Fi, Bluetooth, mobile connectivity and sensors working correctly;
- have working Face ID, Touch ID, fingerprint recognition, NFC and home button where applicable;
- show no sign of liquid damage, corrosion, bending, lifting or poor fitting;
have battery health of at least 83% where the device reports battery health; and
- be a UK model running genuine, unmodified software, with no jailbreak, root, activation lock or account lock.

Poor

A device selected as Poor may show ordinary signs of use, but must:
- have only light cosmetic scratches or scuffs on the screen, housing or camera surround;
- have no cracked glass, deep scratches that can be felt, severe dents, bending, pressure marks, screen burn, discolouration or dead pixels;
- power on, charge and remain fully functional, including its display, touchscreen, cameras, audio, buttons, connectivity and sensors;
- have working Face ID, Touch ID, fingerprint recognition, NFC and home button where applicable;
- show no sign of liquid damage or corrosion;
- have battery health of at least 83% where the device reports battery health; and
- have no jailbreak, root, activation lock or account lock.

Faulty

Faulty is intended for a device with no more than two material faults. Examples include:
- cracked or chipped glass, deep scratches, dents, bending, engravings, pressure marks, screen burn, discolouration, dead pixels or display delamination;
- a lifted or poorly fitted screen, dust beneath the screen or camera glass, or a damaged housing;
- a charging fault, intermittent freezing or restarting, overheating, weak battery or battery health below 83%;
- faulty buttons, touchscreen, Face ID, Touch ID, fingerprint recognition, NFC, cameras, microphones, speakers, earpiece, proximity sensor, vibration, Wi-Fi, Bluetooth or mobile connectivity; or
- signs of previous repair or non-genuine replacement parts.

A Broken quote may be revised if the device has more than two material faults, does not power on, has severe LCD or OLED damage, extensive liquid damage, missing internal components, significant tampering, or a fault materially more serious than the description selected. A device that cannot be safely handled or commercially processed may have no purchase value.

Requirements applying to every condition

- Activation locks, Find My and manufacturer or Google accounts must be removed before payment.
- The device must not be blacklisted, barred, reported lost or stolen, counterfeit, or subject to finance or another person’s rights.
- A required integrated or model-specific stylus must be included where the quote assumes one is supplied.
- Do not send boxes, chargers, cases, SIM cards, memory cards or other accessories unless we specifically request them; they may not be returned.
- A non-UK model, modified software, repair, replacement part or missing feature may affect compatibility and value and may result in a revised offer.
- The examples above are not exhaustive. A combination of cosmetic and functional issues may place a device in a lower category.

If inspection shows that the selected condition is inaccurate, we will explain the relevant findings and follow the revised-offer process in section 9. We will not treat our inspection decision as preventing you from rejecting a revised offer and requesting the device back under section 12.

8. Receipt and inspection

Tracking may show delivery before the parcel has been opened and booked into our system. We will inspect the device within a reasonable time after receipt.
Inspection may include checking its model, storage, cosmetic and functional condition, battery, cameras, screen, buttons, charging, connectivity, IMEI or serial number, account locks, repair history and whether genuine parts appear to be present.

9. Original or revised offer

If the device matches the description and the quote remains valid, we will approve the original quote for payment.

If it does not match the description, has arrived outside the quote period, is locked, has faults, contains non-genuine parts or market pricing has materially changed after the quote expired, we may email you a revised offer with the reason for the change.

You have seven calendar days from our revised-offer email to accept or reject it using the link provided or by contacting us. We will not treat silence as acceptance. If you do not respond, we may send a reminder and then arrange return of the device to the address supplied in your order.

10. Accepting an offer and transferring ownership

A binding sale is formed when we confirm acceptance of the original quote or you accept a revised offer and we dispatch payment. Ownership of the device transfers to us when payment is dispatched. Until then, the device remains yours, subject to these terms and any lawful steps required for a suspected stolen or blacklisted device.

Once payment has been dispatched and ownership has transferred, an accepted sale cannot normally be reversed simply because you change your mind

11. Payment

We aim to dispatch payment within 24 hours after inspection is completed and the applicable offer has been accepted. This is a service target rather than a guarantee where checks, weekends, bank processing, incorrect payment details, suspected fraud or events outside our reasonable control cause delay.

You are responsible for providing accurate payment details in the name of the person selling the device. Tell us immediately if you believe the details are wrong. We are not responsible for delay or loss caused by incorrect details you supplied, although we will take reasonable steps to help recover a misdirected payment.

12. Return and blacklisted devices

If you reject a revised offer, we will normally return the device to the UK address supplied with the order at no charge. Check that address before requesting a return. We are not responsible for loss caused solely by an incorrect address you supplied, but we remain responsible for using reasonable care when arranging the return.

If an IMEI or serial-number check shows that a device is blacklisted, blocked, reported lost or stolen, or subject to an unresolved ownership issue, we may pause the return while we make reasonable enquiries or comply with a lawful request from an authority or network provider.

Where a device is confirmed as blacklisted and it may lawfully be returned to you, we may charge a £25 administration and return fee reflecting the additional checks, handling and secure postage required. We will explain the reason and provide payment instructions before charging it. We will not impose the fee where the blacklist result was caused by our error or cannot reasonably be substantiated. This clause does not limit your right to challenge the finding or make a complaint.

13. Cancellation

You may cancel an order before posting the device by contacting us. If you have already posted it, tell us immediately. We will try to stop processing, but we may need to receive and identify the parcel before returning it. Nothing in these terms removes any cancellation or other statutory right that applies to you.

14. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot legally be excluded.

We are not responsible for indirect or unforeseeable loss, loss of business or profit, or loss of device data. As our service is intended for consumers, you agree not to use it for business resale without our written agreement.

15. Events outside our control

We are not responsible for delay caused by events outside our reasonable control. We will take reasonable steps to reduce the effect, keep you informed and resume the service as soon as reasonably possible.

16. Complaints

Email complaints to help@phoneswapper.co.uk with your order number and a clear description of the issue. We will acknowledge and investigate the complaint within a reasonable time. Your statutory rights are unaffected.

17. Changes to these terms

We may update these terms from time to time. The version applying to an order is the version shown when you submit that order, unless a change is required by law and must apply sooner.

18. General Terms

If a court finds part of these terms unlawful or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not waive that right. No person other than you and us has a right to enforce these terms.

19. Governing Law

These terms are governed by the law of England and Wales. You may bring proceedings in the courts of the part of the United Kingdom where you live where consumer law allows.
